Section 9(b)(3) prohibits the National Labor Relations Board (NLRB or Board) from finding appropriate any bargaining unit comprised of both guards and nonguards, and from certifying a guards' union that admits nonguard members or is affiliated with an organization that admits -nonguards such as SEIU who admits both security guards and non-guards into their membership. 

Although Section 9(b)(3) prohibits the Board from compelling an employer to recognize a mixed-guard union, an employer may voluntarily recognize a union disqualified from Board certification and may also recognize a bargaining unit comprised of both guards and nonguards.


Recently, in Truck Drivers Local 807 v. NLRB,7 the Court of Appeals for the Second Circuit held that under section 9(b)(3) an employer who had voluntarily recognized a mixed-guard union may withdraw recognition upon expiration of its collective bargaining agreement.

In 2014 there were 14.5 million union members in the U.S. Many of these union members are members of a nonguard union. Today there are over 1 million plus security guards that are responsible for protecting both the employers property and the safety of those who work or visit such facility or workplace.  Out of the 1 million plus security guards that make their profession in the security industry, approximately 50,000 of those security guards belong to a 9(b)(3)  security guard union. A security guard union that only admits security guards into its membership.

While there are thousands of labor unions representing all trades and crafts for nonguard members, there are less than a handful of 9(b)(3)  security guard unions that the National Labor Relations Board will certify to represent security guards.

For the majority of the 50,000 plus security guards who have decided to join a security guard union, over the years they have seen yearly wage increases, better benefits, including healthcare benefits, retirement benefits, more sick days, holidays and vacation days. Security guards who belong to a security guard union also receive better working conditions since most unionized security guards are under a collective bargaining agreement that outlines what management can and cannot do.

Many of these same security guards also are entitled to seniority  rights, just cause protection vs. being at-will, job security and many other security guard union benefits as noted and outlined in their site specific collective bargaining agreements which are negotiated by their security guard union representatives who become certified as their exclusive bargaining agent
by the National Labor Relations Board (NLRB) after the NLRB conducts such an election.
